RE: The tariff classification of a gas compressor from Mexico

Dear Ms. Witkum:

In your letter dated September 18, 2009 you requested a tariff classification ruling. Descriptive literature was submitted.

The item you plan to import is described as the CTI-Cryogenics 9600 Compressor. This rotary gas compressor is designed to work with specific types of cryogenic vacuum pumps. Typically, the compressor is located remotely and is connected to the cryogenic vacuum pump by long stainless steel hoses. It is part of a cryogenic vacuum pump system that is used in the manufacture of wafers with integrated circuits, data storage, flat panel displays, compact discs and coatings for eyeglasses and optical devices.

The compressor is used to compress helium gas for circulation within the vacuum pump system. It is generally made of stainless steel or copper and has an input power that ranges from 2 kW to 16.5 kW. The compressor is not interchangeable with all cryogenic vacuum pump systems.

The applicable subheading for the gas compressor will be 8414.80.2055, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other compressors, including reciprocating and rotary, not exceeding 186.5 kW. The general rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
